Terms of Service

These Terms of Service govern your use of CarOtter, an app for iPhone and iPad that helps you track vehicle information, service history, fuel history, and OBD-II diagnostics. By downloading, accessing, or using CarOtter, you agree to these Terms. If you do not agree, do not use the app.

CarOtter is currently provided free of charge and may include experimental or beta features. It is offered as a convenience tool, not as a replacement for professional automotive, safety, legal, or emergency advice. CarOtter also does not operate a developer-hosted cloud backend for routine app data.

1. License and Permitted Use

Subject to these Terms, you are granted a limited, personal, non-exclusive, non-transferable, revocable license to use CarOtter for your own lawful, non-commercial use on devices you own or control.

You may not copy, sell, sublicense, redistribute, reverse engineer, modify, interfere with, or misuse CarOtter except as permitted by applicable law.

2. Eligibility and Compliance

You are responsible for using CarOtter in compliance with applicable laws, regulations, and third-party terms that apply to your use of your device, vehicle, OBD adapter, and selected service providers.

You may use CarOtter only if you can legally form a binding agreement under applicable law.

You represent and warrant that you are not located in, under the control of, or a resident of any country or territory subject to U.S. embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.

3. Safety and Vehicle Responsibility

CarOtter is not designed for use while driving. Do not view, type, scan, troubleshoot, or otherwise interact with the app while operating a vehicle.

You are solely responsible for vehicle operation, maintenance, repair, inspection, emissions compliance, and safety decisions. Any reminders, interpretations, summaries, or recommendations shown by CarOtter are informational only.

4. Diagnostics, AI, and Scan Limitations

CarOtter depends on information from your device, your vehicle, third-party hardware, and third-party services. Because of that, outputs may be incomplete, delayed, inconsistent, or incorrect.

  • OBD-II and vehicle data may vary by vehicle, adapter, network, ECU support, sensor behavior, and manufacturer-specific implementations.
  • AI-generated outputs may be inaccurate, incomplete, outdated, or unsuitable for your situation and must be independently reviewed before you rely on them.
  • VIN, OCR, receipt, odometer, and document scans may misread content, omit details, or produce incorrect extracted values.

CarOtter does not guarantee that any diagnostic result, maintenance suggestion, readiness status, service extraction, or AI response is accurate or fit for a particular purpose.

5. No Professional Automotive or Safety Advice

CarOtter does not provide mechanic, dealership, engineering, inspection, emissions, recall, legal, insurance, or emergency services. Nothing in the app constitutes professional advice or a warranty about the condition, roadworthiness, legality, or safety of any vehicle.

If you suspect a safety issue, mechanical failure, recall issue, or emergency condition, stop using the app as a decision-making substitute and consult a qualified professional or emergency services as appropriate.

6. Third-Party Services and Hardware

Some CarOtter features rely on third parties or third-party hardware, including Apple Sign In, Apple speech services, NHTSA VIN decoding, OpenAI, Google Gemini, Anthropic, xAI, and compatible Bluetooth OBD-II adapters.

Except where you choose to use one of those third-party services or contact the developer directly, CarOtter is not intended to transmit your routine vehicle, service, fuel, chat, scan, or diagnostic records to developer-operated servers.

  • You are responsible for complying with the terms, privacy policies, and usage rules of any third-party service or hardware you choose to use.
  • If you provide your own AI API key, you are responsible for that key, any usage charges, and any data you choose to send through those services.
  • CarOtter is not responsible for third-party outages, policy changes, hardware failures, billing, retention practices, or output quality.

7. Privacy

Your use of CarOtter is also subject to the Privacy Policy, which explains how information is handled in the app, when information stays on-device, and the limited situations where information is sent directly from your device to third-party services you choose to use.

8. Availability, Updates, and Support

CarOtter is currently offered free of charge and may be modified, limited, suspended, or discontinued at any time, with or without notice. Features may change, move behind new requirements, or stop working due to app updates, OS changes, service changes, or hardware changes.

No guaranteed support, maintenance, uptime commitment, or service level is provided unless expressly stated otherwise in writing.

9. Ownership

CarOtter and its associated design, text, code, branding, and other app content are protected by intellectual property laws. Except for the limited license above, no rights are granted to you.

10. Disclaimer of Warranties

To the maximum extent permitted by applicable law, CarOtter is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, and quiet enjoyment.

Nothing in these Terms is intended to limit any non-waivable rights you may have under applicable consumer protection law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, CarOtter and its developer will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, vehicle value, business opportunity, or use.

To the maximum extent permitted by applicable law, CarOtter and its developer will also not be liable for accidents, vehicle damage, missed maintenance, failed inspections, emissions or readiness results, incorrect diagnostics, third-party service failures, adapter failures, or decisions you make based on app output.

12. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold harmless CarOtter and its developer from claims, losses, liabilities, damages, and expenses arising out of your misuse of the app, your violation of these Terms, your violation of applicable law, or your use of third-party services or hardware in connection with CarOtter.

13. Termination

These Terms apply until terminated. Your right to use CarOtter ends automatically if you violate these Terms. You may also stop using the app at any time by removing it from your device.

14. Additional Apple App Store Terms

If you downloaded CarOtter through Apple's App Store or TestFlight, you acknowledge that these Terms are between you and CarOtter, not Apple, and that Apple is not responsible for CarOtter or its content.

  • The license granted to you is limited to use of CarOtter on Apple-branded products that you own or control and as permitted by the App Store usage rules.
  • Apple has no obligation to provide maintenance or support services for CarOtter.
  • Apple is not responsible for addressing claims relating to the app, including product liability claims, regulatory claims, privacy claims, claims under consumer protection law, or intellectual property infringement claims. Such claims should be directed to the developer through the contact information below.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Changes to These Terms

These Terms may be updated from time to time. If they are updated, this page will be revised and the Last Updated date above will be changed. Your continued use of CarOtter after an update means you accept the revised Terms.
